The #immigration judge had declared that Abrego Garcia was "more likely than not" to face persecution in #ElSalvador & the #Trump admin sent him there.
They even admit they knew, “although ICE was aware of his protection from removal to El Salvador, Abrego Garcia was removed to El Salvador because of an administrative error” & STILL they will not do anything to bring him back.

They are arguing they don’t have jdx because he’s in El Salvador. He’s in El Salvador because they *mistakenly* sent him there. And the US govt is PAYING #ElSalvador to hold him in the detention center there.

Abrego has NO criminal record. NONE. He was arrested (but not charged) while looking for day labor outside a Home Depot in 2019. When he was arrested he denied being in any gang. Local PD said he was MS-13 because he was wearing #ChicagoBulls clothes, & allegedly a "confidential informant" said he was part of an MS13 clique in a state where he never lived.

The DoJ is not saying whether the USG and El Salvador have contractual arrangements that give the US continuing rights. Did it require El Salvador to keep all prisoners indefinitely? That would be novel. Besides, El Salvador's president already returned prisoners he did not bargain for. The US could also just ask for him back, to correct an egregious wrong.
The DoJ is hairsplitting and bullshitting, unlawfully imprisoning a man because Donald Trump wants to appear invincible.

The various rationalizations don't need to hang together in any logical way; those exist to make those opposed answer them, which is rather difficult when they're nonsense. (The nonsense is the point.)
The actual purpose is ethnic cleansing; the US will be a white majority country. They're getting ramped up for mass graves, but in the meantime, they're redefining "citizen" as "white evangelical man who owns property and at least one woman."
