The filing undercuts public statements & court filings to the contrary by #Trump ofcls.
There are at least 3 #AppointmentsClause cases against Musk's exercise of govt authority.
So Musk trying to have his cake and eat it too. He’s too busy being a high level government official to be forced to honor a deposition, BUT he’s NOT a high ranking government official for the purposes of needing Senate confirmation & security clearance, following all other obligations of running a government office, such FOIA requests.
Methinks the Delaware Court should do some fact-finding about Musk’s claim — maybe get some sworn statements or testimony.
